Terms of Use

1. Agreement

These terms form an agreement between you and Andromeda Forge LLC, a limited liability company organized under the laws of the State of New Mexico, United States. By downloading, installing or using one of our applications, you accept them. If you do not accept them, do not use the application.

Applications distributed through the App Store are also subject to the Licensed Application End User License Agreement of Apple. Where these terms and that agreement conflict, the Apple agreement prevails for anything it covers.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use our applications on devices you own or control, for your own use, in accordance with the App Store rules and with these terms.

You may not resell, rent, sublicense or redistribute the applications, nor reverse engineer, decompile or disassemble them except where that restriction is prohibited by applicable law. You may not remove or alter any notice of ownership contained in them.

3. Ownership

The applications are licensed, not sold. Andromeda Forge LLC retains all right, title and interest in them, including their source code, design, text, artwork and trade marks. Nothing in these terms transfers ownership of anything to you.

4. Acceptable use

You agree not to use our applications to break the law, to interfere with their normal operation or security, or to attempt to reach systems or data you have no right to reach.

Where an application controls or communicates with physical hardware, you are responsible for using that hardware in accordance with the instructions and safety limits of its manufacturer. We do not manufacture accessories and we do not warrant the safety or fitness of any third-party device you choose to connect.

5. Health and fitness

Our applications are training and productivity tools. They are not medical devices, they give no medical advice, and nothing they display should be treated as a diagnosis or as a substitute for professional advice. If you have a medical condition, or are unsure whether an activity is safe for you, consult a qualified professional before using them. Stop if you experience pain or discomfort.

6. Availability and changes

We may update, change or discontinue an application, or any of its features, at any time. We may also stop supporting older operating system versions. We are not obliged to maintain compatibility with any particular device or accessory.

7. Purchases and refunds

All purchases are processed by Apple and governed by the terms of Apple. Refunds are requested from and granted by Apple, at the discretion of Apple. We can neither issue nor refuse a refund on behalf of Apple.

8. Disclaimer of warranties

To the maximum extent permitted by applicable law, our applications and this website are provided as is and as available, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that an application will be uninterrupted, error free, or compatible with every device.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any right you have as a consumer that cannot be waived under the law of your country of residence.

9. Limitation of liability

To the maximum extent permitted by applicable law, Andromeda Forge LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, profits or goodwill, arising out of your use of or inability to use our applications.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid for the application in the twelve months preceding the claim, or fifty United States dollars.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

10. Termination

This licence ends automatically if you breach these terms. You may end it at any time by deleting the application. Sections 3, 8, 9 and 11 survive termination.

11. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws rules. If you are a consumer resident in another country, this choice of law does not deprive you of the protection of the mandatory consumer law of your country of residence.

12. Changes to these terms

We may revise these terms. The date at the top of this page shows when they were last changed. Continuing to use an application after a revision means you accept it.
